Sources close to both sides say NHL, NHLPA agree on Salary Cap structure

Thursday, June 9, 2005

The Globe and Mail (Toronto, ON), citing sources close to both sides in the dispute, reported Wednesday that the National Hockey League and the NHLPA have agreed to a salary cap structure, arguably the most contentious issue in the continuing lockout that led to the cancellation of the 2004-05 NHL season on 16 February, 2005.

The Globe and Mail is reporting that the deal, providing the “cost certainty” that the NHL has been seeking, will consist of a floating, team-by-team salary cap and floor based on a percentage of each team’s revenue projections. What is being reported as a six-year deal has a salary cap range of $34-36 million and a salary floor of $22-24 million, both hard caps. The new deal will also reportedly include the across-the-board 24% decrease in salary offered by the NHLPA in February. A dollar-for-dollar Luxury tax will also take effect at the halfway point between the lowest salary floor and the highest salary cap (slated to be $29 million for the first year of the deal). Details about what will be done with this money have not been completely worked out, but it is thought that this money will be distributed to teams below the halfway point in such a way as to make sure they remain above the salary hard minimum.

While this is one of the most contentious issues in the labor dispute, there are several other issues that may delay the signing of a new Collective Bargaining Agreement. These include deciding how high-payroll teams will drop to the new maximum, working on new systems for salary arbitration, free agency, Olympic participation, and drug testing, and to design a complete revenue-sharing system.

Sell My House In Phoenix In Record Time!

By Reed Lattin

When I needed to sell my house in Phoenix really quickly, I turned to a company that was willing to give me an offer on my house right away. I was in debt, and I knew my only solution was to sell my house in Phoenix. I had read on the Internet that there were places that would give you money right away, so I decided to call one of them to sell my Phoenix house. What I found was that when you factor in all of the costs associated with selling a house through a real estate agent, I was going to save money if I chose to sell my house in Phoenix to this company. I really needed to sell my home in Phoenix very quickly.

If I had to sell my house in Phoenix with a real estate agent, I would have been hit with many fees. I was not prepared to pay any fees at the time to sell my home in Phoenix. I did not have to pay any fees when I needed to sell my house in Phoenix with the company I chose. I was also very happy to see that when I did sell my house in Phoenix there were no closing costs involved to sell my Phoenix house. I did not have to worry about contingencies either. In other words, there was no initial cost involved, and no final closing cost.

To sell my house in Phoenix with this company was a delight. I was given an offer to sell my house in Phoenix the very next day after having contacted them. I accepted the offer to sell my house in Phoenix because it was a fair and honest offer. I was happy to sell my home in Phoenix to this company because it was fast and easy, with no hidden surprise costs. I just received my cash money when I did sell my house in Phoenix, and was able to put it towards a smaller house. I made the choice to sell my Phoenix house to avoid a foreclosure that was inevitable.

I was happy to get a smaller house, but when I need to sell my home in Phoenix someday, I will definitely return to the company I was dealing with. When I needed to sell my house in Phoenix very quickly, they helped me with all the paperwork to make it as simple as possible. I know that if I had used a real estate agent to sell my Phoenix house it would have been too confusing and a very lengthy process. That’s why when I did decide to sell my house in Phoenix, I chose the fastest and easiest method I could.

One important lesson that I learned while going through this experience to do research on the company you are dealing. Call the Better Business Bureau to verify their track record. Furthermore, have an attorney review the documents before you sign anything.

Israeli PM Ariel Sharon to undergo more surgery

Sunday, January 15, 2006

Ariel Sharon, 77, is scheduled to undergo a tracheotomy today, which is expected to help wean him off a respirator, which is helping him to breathe, a hospital statement said.

A tracheotomy is a procedure where an incision in the windpipe is made to create a temporary or permanent opening. It will allow for the removal of the breathing tube now inserted in Sharon’s throat. Sharon suffered a major stroke on January 4, 2006. Last week, doctors said the plastic tube connecting his windpipe with the respirator would start to cause him damage if left in for too long.

Tracheotomies are routinely performed on stroke victims to reduce the risk of infection posed by intubation.

“The prime minister’s condition continues to remain critical but stable,” said a statement issued by Jerusalem’s Hadassah hospital where doctors have been trying, unsuccessfully, to wake Sharon from a medically induced coma. “This evening the prime minister will undergo a CT test after which he will undergo a tracheotomy. The surgery is aimed at helping to wean him off a respirator machine. It will be conducted in the operating room under general anaesthesia.”

Microsoft claims 235 patent breaches by open source software

Tuesday, May 15, 2007

Software giant Microsoft’s chief lawyer Brad Smith claimed in an interview published in the magazine Fortune on Monday that open-source software products violate 235 of Microsoft’s patents. The main transgressors are claimed to be Linux (107 patents) and OpenOffice.org (45), with e-mail programs infringing 15 patents. Microsoft wants royalties to compensate for the patent breaches.

According to Microsoft’s Vice-President of intellectual property and licensing, Horacio Gutierrez, the company wants to negotiate with the open-source companies rather than sue them. “If we wanted to litigate we would have done that a long time ago. Litigation is not an effective way of going about solutions,” Gutierrez said. According to him, Microsoft has over the last years tried to work towards a “constructive” solution to the alleged problem of patent violation.

Microsoft in the past has used the strategy of cross-licensing to get royalties from companies who infringe their patents, for example in their deal with Novell. On a company blog, Novell reiterated that their deal “is in no way an acknowledgment that Linux infringes upon any Microsoft intellectual property.”

“We don’t think that customers will want to continue on without a solution to the problem,” Gutierrez said about Microsoft’s approach to guaranteeing companies that they won’t get sued because they use the allegedly patent-infringing Linux operating system.

The upcoming third version of the GPL licence, the licence under which Linux is released, will prohibit Linux distributors to agree to patent royalty deals. Microsoft called these “attempts to tear down the bridge between proprietary and open-source software that Microsoft has worked to build with the industry and customers.”

A related U.S. Supreme Court ruling from April 30th showed how software patents can be subject to court challenges; basically, if the innovations patented are “obvious”, the patent is weakened. Joe Lindsay, information officer for a mortgage company, pointed out that the Unix code that Linux is based upon preceded Microsoft Windows, which might also be a reason for some patents to be invalid.

Red Hat, the biggest Linux distributor, said in a statement on Monday:

The reality is that the community development approach of free and open source code represents a healthy development paradigm, which, when viewed from the perspective of pending lawsuits related to intellectual property, is at least as safe as proprietary software.

Larry Augustin, former CEO of a company called VA Linux (now VA Software), responsible among other things for launching SourceForge.net, an open-source software development community, posted a message on his blog under the title “It’s Time for Microsoft to Put Up or Shut Up”:

If Microsoft believes that Free and Open Source Software violates any of their patents, let them put those patents forward now, in the light of day, where we can all evaluate them on their merits. If not, then stop trying to bully customers into paying royalties to use Open Source.

According to the Fortune report, more than half of the Fortune 500 companies are estimated to use Linux in their data centers.

Earth Day 2009 celebrated around the globe

Wednesday, April 22, 2009

Today is the 39th observance of Earth Day in the northern hemisphere. Earth day is celebrated in Autumn on November 30 in the southern hemisphere. Senator Gaylord Nelson initiated the first Earth Day in April 1970 in the United States, and it is now celebrated by over 1 billion people in over 170 countries worldwide. Earth Day is the biggest environmental event which addresses issues and educates people on environmental awareness on a global scale.

This year, National Aeronautics and Space Administration (NASA) will beam high-definition images to the NASA website and television. By doing so, NASA hopes to increase appreciation of global climate issues. There will also be a Washington exhibit relating to environmental issues viewed from space as well.

At the NASA Marshall Space Flight Center activities will focus on their slogan for Earth Day 2009, “Just One Drop … PRICELESS” and will demonstrate how the Environmental Control Life Support System operates as used on the International Space Staton (ISS).

Amongst the many festivals, WorldFest is a solar powered music celebration held in Los Angeles, California. Buenos Aires will also feature its second Earth Day event featuring a music festival as well.

“We are in a new era of energy innovation,” said Daniel Yergin at a Massachusetts Institute of Technology (MIT) forum. Lithium-ion batteries are providing electric storage solutions for electric cars such as the Chevrolet Volt and the Dodge Circuit EV. Algae fuel is a new form of biofuel, but is still under development.

“Energy Smackdown” was a competitive household activity which compared energy usage between 60 separate households across three cities in or near Boston. The various competitors came up with a variety of innovative methods to cut their carbon footprint, installing solar electric panels, geothermal heat pumps, wind turbines, and using a caulking gun to seal the home from drafts.

“In the average home, 75 percent of the electricity used to power home electronics is consumed while the products are turned off.” is a United States Department of Energy (DOE) estimate.

Miami is installing a smart grid which will use individual household smart meters to allow energy consumers know via a web site, their exact home energy usage. “To me these are prudent and smart investments that will easily pay for themselves. It will show the nation how to address environmental, energy, and economic challenges all at the same time.” said Miami mayor Manny Diaz.

Cal Dooley, CEO of the American Chemistry Council ACC, says the plastic bag industry is prepared to spend US$50 million to revamp their manufacturing facilities and will collect 470 million pounds of recycled plastic every year to make plastic bags of 40% recycled content. The ACC is providing a donation to the Keep America Beautiful environmental organisation, both of whom endorse this new project. The Earth Day Network (EDN) and Natural Resources Defense Council (NRDC) would like to see an end to the use of plastic bags, however. “We don’t want people to use disposable bags. We want people to use reusable bags,” says Darby Hoover of the NRDC.

Calgary researchers will begin field surveys to help save the “Northern Leopard Frog (Rana Pipiens). “Northern Leopard Frogs are threatened in Alberta, but endangered in British Columbia,” said Dr. Des Smith, Primary Investigator and Research Scientist with the Calgary Zoo’s Centre for Conservation Research. “It is essential to develop new monitoring techniques for Northern Leopard” said Breana McKnight, Field Team Leader and Endangered Species Researcher.

The traditional Earth day ceremony of planting trees is garnering further attention in Japan as Koichi Nakatani, the nation’s Tree Planting Father travels from Hokkaido to Okinawa.

Students can take part in an Earth Day photo contest sponsored by the Institute for Global Environmental Strategies which will feature images and scientific student research for the environmental change depicted in each photo submitted.

“Earth Day should be about teaching about the environment every day,” said Sean Mille director of education for EDN, “We emphasize taking action for your classroom, school, district or community.” 25,000 schools across America made use of the environmental curriculum developed by the National Civic Education Project, the Green Schools Campaign and the Educator’s Network. Lesson plans are broad and varied and may focus on water pollution, recycling, composting, using chemistry to convert cafeteria left-overs into biodiesel or ethanol fuel or converting go-carts to operate on biodiesel or ethanol fuels in shop class.

Are Energy Drinks Dangerous?

Submitted by: Dianne Ronnow

Energy drinks have become increasingly popular, especially with teens and young adults, and more than 500 new energy drinks have launched worldwide last year. But experts are questioning whether people are harming their health by drinking them.

Most energy drinks are just marketing ploys, according to Mark Kantor, professor of family and consumer sciences and nutrition at the University of Maryland, who specializes in consumer education. I’m not aware of any scientific data that they do what they say they’re going to do,” He said “They don’t give you more energy.” For the most part, they are nothing much more than a can full of caffeine and a lot of sugar.

Although herbal ingredients such as taurine and guarana, as well as vitamins and minerals are often added to make these energy drinks sound healthy, the amounts of natural ingredients found in them are usually so small, they make little difference.

Nutritionists warn that these drinks contain excessively high amounts of caffeine and sugar, which can hook kids on an unhealthy jolt-and-crash cycle. The caffeine comes from multiple sources, making it hard to tell how much the drinks contain.

The caffeine in energy drinks can give a temporary or false feeling of energy for a short period of time as it raises the blood pressure, but then the body goes through a dramatic drop in energy an hour or so later as the caffein and sugar leave the bloodstream, causing sluggishness, mood changes, and a burned out feeling.

Not only do energy drinks usually fail to offer a special boost, but their high caffeine and sugar content can cause extreme dehydration, and are considered by medical experts to be dangerous for the young and physically active. Caffeine will worsen insulin sensitivity, which is one of the major causes of diabetes and chronic illness. Other studies have shown that caffeine leads to heart problems. In addition to the caffeine overload, it’s important to stay away from drinks spiked with sugars that raise your insulin levels, contributing to a host of modern diseases such as diabetes and obesity.

Energy drinks should not be used as thirst quenchers or as replenishing liquids when exercising. Energy drinks are not a suitable form of usable energy for the body, which needs good carbohydrates to perform well. When used before sports activities they actually hinder an athlete’s performance by dehydrating the body faster and forcing the muscles to work harder. They slow the body’s ability to absorb water, which is the last thing an athlete needs.

A few of the potential health risks and long term health challenges associated with energy drinks such as Red Bull include depression, heart health, diabetes, nervous system, poor sleeping habits, synthetic chemicals, effects of carbonation, additive behaviors, premature aging.

Energy drinks are even more dangerous when combined with alcohol, which is actually a very popular mixed drink with young people, but doctors warn that mixing such large doses of caffeine with alcohol is dangerous, especially for the heart.

Also, since alcohol already dehydrates a person, when it’s mixed with energy drinks “double dehydration” can occur. The more dehydrated you are, the higher the blood level of alcohol, and the higher the danger. And the caffeine doesn’t make a person less drunk, it just makes them feel more awake, which often falsely leads the person to think they are able to drive. And if that isn t bad enough, energy drinks enhance hangovers because caffeine, like alcohol, is a diuretic and dehydrates the body.

Several countries, such as France and Denmark, have already banned the sales of energy drinks like Red Bull, following the deaths of several people who mixed the energy drink with alcohol.

On Vital Votes, nutrition coach Josh Rubin from San Marcos, California explains, “These drinks are a scam to get people to keep coming back. Americans are so tired that they actually need this stuff to live. When you eat sugar, gluten, etc. your body releases opiates. Then when you stop drinking this crap, you body craves it and you need more.

Symptoms of caffeine overdose include nervousness, insomnia, heart palpitations, tremors, sweating, nausea, diarrhea, chest pain, and neurological symptoms. If an addicted person stops drinking caffeine, it is possible to suffer from withdrawal symptoms such as headache, fatigue, depressed mood and difficulty concentrating.

Many of us would love to have an increased energy boost occasionally, but it is important to realize that energy drinks are not the best way get that. It is far wiser to address the underlying reasons why you do not have as much energy as you would like. To increase your energy you need to live a healthy lifestyle including getting sleep, exercise and healthy food to fuel you body.

A much safer alternative for a quick energy boost can be found from a natural organic company called ForeverGreen. They have recently released a new herbal energy product called AmpliFire. AmpliFire gives you the energy you need to create the life you want today, while supporting your overall health. Don’t risk your health and happiness for artificial energy. AmpliFire is an exclusive combination of safe energy and natural health products.

AmpliFire utilizes ForeverGreen’s patent-pending technology to take natural plant concentrates and render them water-soluble, making them instantly absorbed. These proprietary blends contain natural, safe, clean and organic ingredients for instant energy that lasts for hours.

Kenyan conservancy euthanises last male northern white rhino; only two females remain

Wednesday, March 21, 2018

Yesterday, Kenya’s Ol Pejeta Conservancy announced they had euthanised the last male northern white rhino, Sudan, on Monday, after consulting with wildlife officials. Sudan was 45-years-old, and now only two northern white rhinos, both female and descendants of Sudan, remain.

“Sudan was being treated for age-related complications that led to degenerative changes in muscles and bones combined with extensive skin wounds”, the conservancy said. “His condition worsened significantly in the last 24 hours; he was unable to stand up and was suffering a great deal”, they added.

Sudan, who was born in the early 1970s, suffered a wound in his right hind leg in late February. He was born in South Sudan, and at that time around 700 northern white rhinos were alive.

Sudan was in captivity for the last 38 years. Earlier, he was kept at the Dv?r Králové Zoo in Czech Republic before he was moved to Kenya. He stayed in a 90 thousand acre (about 140 square mile, 364 square kilometre) reserve with the only two remaining female northern white rhinos, 27-year-old Najin and seventeen-year-old Fatu. Najin and Fatu are Sudan’s daughter and granddaughter, respectively.

Ol Pejeta said they collected Sudan’s genetic material on Monday. The conservancy said, “The only hope for the preservation of the subspecies now lies in developing in-vitro fertilisation techniques using eggs from the two remaining females, stored northern white rhino semen from males and surrogate southern white rhino females.”

Last year, an account was opened on dating platform Tinder on Sudan’s behalf, to raise money for a fertility treatment after attempts at natural mating proved futile. Suni, second to last male of the subspecies, died four years ago, in October 2014 in San Diego Zoo, US. He was 42.

Ol Pejeta’s CEO, Richard Vigne, said Sudan “was a great ambassador for his species and will be remembered for the work he did to raise awareness globally on the plight facing not only rhinos, but also the many thousands of other species facing extinction as a result of unstable human activity”.

In 2008, the World Wildlife Foundation declared northern white rhinos extinct in the wild.

Law center helps defend open source

Wednesday, February 2, 2005

Eben Moglen, Columbia University Law Professor, will head the newSoftware Freedom Law Center (SFLC). An initial 4 million dollars has been provided by Open Source Development Labs (OSDL) to fund the project.

The law center will provide free legal service for open source projects and developers. In 2004 OSDL established a separate $10 million Linux Legal Defense Fund providing legal support for Linus Torvalds, Linux kernel creator and end user companies subjected to Linux-related litigation by the SCO Group. The new law center will not be affiliated with the OSDL.

“This is about taking care of the goose that laid the golden egg and not letting wolves come in the middle of the night and steal it away,” Moglen said during a press conference. “This is a legal firm not involved so much in litigating and defending as it will be for counseling and advising and nurturing non-profits and to prevent millions of dollars in litigation.”

Moglen will serve as chairman and director-counsel of the non-profit organization. Also on board as directors are: Lawrence Lessig, law professor at Stanford Law School; Daniel Weitzner, director of the World Wide Web Consortium‘s technology and society activities; and Diane Peters, general counsel at the OSDL. Daniel Ravicher, executive director of the Public Patent Foundation, will help manage as legal director.

Moglen, one of the world.s leading experts on copyright law as applied to software, will run the new Law Center from its headquarters in New York City. The Law Center will initially have two full-time intellectual property attorneys on staff and expects to expand to four attorneys later this year. Initial clients for the Law Center include the Free Software Foundation and the Samba Project.

Other services provided by the SFLC include: asset stewardship, to avoid intellectual property claim conflict; license review and compatibility analysis; legal consulting and lawyer training.
